These Terms and Conditions (“Terms”) govern your access to and use of the website located at wowhow.cloud (the “Website”), operated by Absomind Technologies (“Company,” “we,” “us,” or “our”). The Website provides a digital products marketplace (the “Service”) where users may browse, purchase, and download premium digital products including but not limited to templates, UI kits, design systems, code components, and related digital goods.

By creating an account, making a purchase, downloading any product, or otherwise accessing the Service, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding contractual agreement. If you are accessing the Service on behalf of an organization, you further represent that you have the authority to bind that organization to these Terms.

Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes. We encourage you to review these Terms periodically.

To access certain features of the Service, including the ability to purchase and download products, you may be required to create an account. When registering, you agree to provide accurate, current, and complete information and to promptly update such information to keep it accurate and complete.

You are solely responsible for safeguarding your account credentials, including your password, and for all activities and transactions that occur under your account. You must not share your account credentials with any third party. You agree to notify us immediately at support@wowhow.cloud upon becoming aware of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend, disable, or permanently terminate your account at our sole discretion, with or without prior notice, for conduct that we determine: (a) violates these Terms; (b) is harmful to other users, the Company, or third parties; (c) involves fraudulent, abusive, or otherwise objectionable activity; or (d) is necessary to protect the integrity of the Service.

All digital products available through the Service are licensed, not sold. Upon successful purchase and complete payment, you are granted a non-exclusive, non-transferable, perpetual commercial license to use the purchased digital product(s) subject to the following terms:

• Commercial Use Permitted: You may use purchased products in an unlimited number of personal and commercial projects, including but not limited to client work, SaaS applications, websites, mobile applications, marketing materials, and digital products you build for end users.
• Unlimited Projects: There is no restriction on the number of end products or projects in which you may incorporate the purchased products, provided each use complies with these Terms.
• No Redistribution: You may not redistribute, resell, sublicense, lease, share, or otherwise make the purchased products available to third parties as standalone files, in a file-sharing arrangement, or as part of any competing product, template marketplace, or asset library.
• No Derivative Resale: You may not create derivative works from purchased products for the purpose of reselling them as digital products, templates, themes, design kits, or similar assets. This restriction applies regardless of the degree of modification.

Specific license terms applicable to individual products may vary and will be indicated on the respective product listing page. In the event of a conflict between these general Terms and any product-specific license, the product-specific license shall prevail to the extent of the inconsistency.

All prices displayed on the Service are denominated in Indian Rupees (INR) unless otherwise specified. Prices are inclusive of applicable taxes unless explicitly stated otherwise at the point of sale.

Payments are processed securely through Razorpay, our authorized third-party payment gateway. By completing a purchase, you agree to comply with Razorpay's applicable terms of service and privacy policy in addition to these Terms. We do not store your full payment card details on our servers; all sensitive payment information is handled directly by Razorpay in accordance with PCI-DSS standards.

In exceptional circumstances, and entirely at our sole and absolute discretion, we may consider a refund request only in the following limited cases:

• Duplicate Purchase: You were charged more than once for the same product due to a verifiable payment processing error.
• Technical Failure: A verified technical issue on our end prevented you from accessing or downloading the product, and we were unable to resolve the issue within a reasonable timeframe.
• Material Misrepresentation: The delivered product is fundamentally and materially different from what was described on the product listing page, as determined by us.

Any refund request must be submitted within 7 calendar days of the original purchase date by contacting support@wowhow.cloud with your order details and a clear description of the issue. Requests submitted after this period will not be considered. We reserve the right to deny any refund request that does not meet the criteria outlined above, and our decision on all refund matters is final.

All content on the Service, including but not limited to text, graphics, logos, icons, trademarks, service marks, images, audio, video, software, source code, product designs, and the compilation and arrangement thereof (collectively, the “Content”), is the exclusive property of Absomind Technologies or its licensors and is protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

The WOWHOW name, logo, taglines, and all related names, marks, product and service names, designs, and slogans are trademarks of Absomind Technologies. You may not use, reproduce, or display any such trademarks without our prior written consent. Unauthorized use of our trademarks may constitute a violation of applicable trademark laws.

Purchasing a product from the Service grants you only the specific license rights described in Section 3 above and any applicable product-specific license. No transfer of intellectual property ownership occurs upon purchase. Absomind Technologies and/or the original creators retain all rights, title, and interest in and to the digital products, including all intellectual property rights therein.

When using the Service, you agree to conduct yourself lawfully, respectfully, and in accordance with these Terms. You agree not to:

• Violate any applicable local, state, national, or international law, regulation, or ordinance.
• Infringe upon or misappropriate the intellectual property rights, privacy rights, or proprietary rights of any third party.
• Upload, transmit, or distribute any viruses, worms, trojans, malware, or other harmful or destructive code.
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, computer systems, or networks connected to the Service through hacking, credential harvesting, or any other means.
• Interfere with, disrupt, or impose an unreasonable burden on the Service, its servers, or the networks used to make the Service available.
• Use any automated means, including bots, scrapers, crawlers, or spiders, to access, monitor, or copy any content from the Service without our express written permission.
• Misrepresent your identity, impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.
• Circumvent, disable, or otherwise interfere with any security-related features of the Service, including features that prevent or restrict the use or copying of any content.

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including but not limited to removing offending content, suspending or permanently terminating accounts, and reporting violations to law enforcement authorities where appropriate.

To the maximum extent permitted by applicable law, Absomind Technologies, together with its directors, officers, employees, partners, agents, suppliers, and affiliates, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, revenue, data, use, goodwill, business opportunities, or other intangible losses, arising out of or in connection with:

• Your access to, use of, or inability to access or use the Service.
• Any conduct, content, or actions of any third party on or through the Service.
• Any content obtained from or through the Service.
• Unauthorized access to, use of, or alteration of your transmissions, data, or content.
• Any errors, omissions, interruptions, deletions, defects, delays in operation, or failures in performance of the Service.

In no event shall the total aggregate liability of Absomind Technologies to you for all claims arising out of or relating to the use of, or inability to use, the Service exceed the total amount paid by you to the Company during the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise.

The Service and all content, products, and features available through the Service are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and course of performance.

We do not warrant that: (a) the Service will function uninterrupted, be secure, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses, malware, or other harmful components; or (d) the results of using the Service will meet your specific requirements or expectations.

Digital products are provided as-is at the time of purchase. While we endeavour to ensure the quality, accuracy, and functionality of all products listed on the Service, we make no guarantees regarding compatibility with specific software versions, frameworks, operating systems, or development environments beyond what is expressly stated in the product description. It is your responsibility to evaluate the suitability of any product for your intended use prior to purchase.

These Terms shall be governed by, and construed and interpreted in accordance with, the laws of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the courts located in India.

Prior to initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@wowhow.cloud. If the dispute is not resolved within thirty (30) days of your initial communication, either party may then pursue formal legal remedies as permitted under applicable law.

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. If a revision constitutes a material change, we will provide at least 30 days' prior notice before the revised terms take effect. Notice may be provided by posting a prominent announcement on the Service, sending an email to the address associated with your account, or through other reasonable means.

What constitutes a material change will be determined at our sole discretion, but may include changes to pricing, licensing terms, refund policies, or any terms that materially affect your rights or obligations. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to render it valid and enforceable while preserving the original intent of the parties. The invalidity or unenforceability of any particular provision shall not affect the validity or enforceability of any other provision herein, and the remaining provisions of these Terms shall continue in full force and effect.
